Do You Need a Permit to Build a Fence in the Regional District of Nanaimo (RDN)?

If you live in an Electoral Area of the Regional District of Nanaimo (RDN) and are planning to build a new fence, one of the first questions you may have is whether you need a building permit.

The good news is that most residential fences do not require a building permit, provided they are less than 2.0 metres (6 feet 7 inches) in height. Even if a permit isn’t required, your fence must still comply with the applicable zoning regulations for your property.

Do I Need a Building Permit?

For most homeowners in the RDN, a building permit is not required for fences under 2.0 metres (6 feet 7 inches) high.

If your fence exceeds 2.0 metres in height, or your project includes a retaining wall or other structural components, additional regulations and permits may apply.

Fence Height and Retaining Walls

If you’re installing a fence on top of a retaining wall, the combined height of the wall and fence may affect whether the structure is considered a “structure” under the zoning bylaw and whether setback requirements apply.

For properties governed by RDN Zoning Bylaw 2500:

  • Fences under 2.0 metres are generally not considered structures.
  • Retaining walls 1.2 metres or higher are considered structures.
  • A retaining wall with a fence on top may also be regulated if the combined height reaches 2.0 metres or more.

Before You Build

Before installing your new fence, we recommend:

  • Confirm your property lines.
  • Contact BC 1 Call before digging.
  • Check for utility easements or rights-of-way.
  • Review the zoning regulations that apply to your property.
  • Speak with your neighbour if the fence will be located on a shared property line.
  • If your property is on a corner lot, make sure your fence will not interfere with sightlines for vehicles or pedestrians.

Taking these simple steps can help avoid costly mistakes and disputes later.
